Preamble
These General Terms of Use (“GTU”) govern access to and use of the website https://www.campusofthefuture.hec.fr/, published by the HEC Foundation, a foundation recognized as being of public utility by decree dated July 5, 1973, whose registered office is located at 1, rue de la Libération, 78350 Jouy-en-Josas Cedex, France, and whose SIRET number is 321 337 081 00038 (“HEC Foundation”).
The user acknowledges having read the GTU and agrees to comply with them.
Article 1 – Definitions
The terms beginning with a capital letter in the GTU have the following meaning (unless explicitly stated otherwise):
Site: refers to the HEC Foundation’s website accessible at https://www.campusofthefuture.hec.fr/ providing access to the Foundation’s Services.
User(s): any natural or legal person browsing the Site for any purpose, whether or not identified through a User Account.
Donation: refers to a financial contribution made online to support the HEC Foundation or one of its specific projects.
Donor: a User who has made an online donation via the donation interface.
Content: refers to any element constituting or published on the Site, whatever its nature, such as texts, sounds, music, photographs, images, logos, graphic elements and interfaces, videos, software, databases, etc.
Equipment: refers to any type of device on which the Sites are displayed, including computers, tablets, and smartphones.
Personal Data: refers to any information relating to a User that makes it possible to identify a natural person directly or indirectly.
Personal Data Protection Policy: the document established by the HEC Foundation presenting its processing of Users’ Personal Data and defining their corresponding rights.
Article 2 – Purpose
These General Terms of Use define the conditions under which Users may access and use the Site, as well as the terms applicable to online donations and pledges made through the HEC Foundation’s website.
Users must carefully read and understand these GTU before making a donation.
By accepting them, Users acknowledge having read them and agree to comply with their terms and conditions.
The HEC Foundation reserves the right to modify all or part of these GTU at any time.
It is therefore the User’s responsibility to refer to the most recent version, permanently available on the HEC Foundation website. If the User does not accept all or part of these GTU, they must refrain from making an online donation.
Article 3 – Access to the Site
Access to the Site is open to any user with an internet connection. The Site is accessible free of charge, excluding internet connection and subscription fees. However, certain sections may be reserved for registered users.
Accessing the Site implies full and complete acceptance of these GTU.
The HEC Foundation cannot be held liable for technical access issues, including malfunction of the Site or unavailability of Content, whether due to force majeure, maintenance operations, editorial updates, internal or external strikes, network failures, power outages, incorrect configuration or use of the User’s device, or any other cause within or outside its control.
Data transfer rate and transmission times from the Foundation’s server to the internet are not guaranteed.
The Foundation cannot be held liable in case of virus contamination or any other computer infection affecting the User’s Equipment. It is the User’s responsibility to implement appropriate protection measures.
Article 4 – Intellectual Property
Unless otherwise stated, all elements on the Site (layout, visuals, text, photographs, drawings, diagrams, trademarks, logos) are protected works under applicable intellectual property laws and belong to the HEC Foundation.
Subject to the provisions of the Intellectual Property Code, these elements may not be used, modified, adapted, represented, incorporated, or translated, even partially, without prior written authorization from the HEC Foundation.
Article 5 – Donation Payment
Both legal entities and adults may make a donation. To make an online donation, the HEC Foundation provides a dedicated page redirecting to its iRaiser solution (https://www.give.fondationhec.fr).
To make a donation, individual Users must provide: email address, first name, last name, postal address, information on whether they graduated from HEC, and optionally phone number, program, and class year.
Legal entities must provide information enabling their identification (business name, SIREN number, legal form, title, registered office address, valid email address) as well as information identifying the authorized representative.
Payment may be made by credit card, bank transfer (direct transfer or IBAN/BIC details), or Apple/Google Pay via iRaiser’s secure payment platform (https://www.iraiser.com).
After making an online donation, the User becomes a Donor, unless they already held this status.
Article 6 – Allocation of Donation and Tax Receipt
The HEC Foundation commits to allocating the donation amount to the project selected by the User, according to the User’s choice at the time of payment.
In return for the donation, the Foundation commits to sending the Donor a tax receipt via the email address provided. The Donor agrees not to receive any other consideration in exchange for the donation.
Article 7 – Personal Data
The HEC Foundation collects and processes your personal data for administrative management of donations, particularly for donation collection. The way personal data is collected and processed is described in the Personal Data Protection Policy.
Article 8 – Liability
Use of the Site is under the sole responsibility of the User. The HEC Foundation cannot be held liable for any direct or indirect damage, including data loss or loss of profit, resulting from access to or use of the Site.
The HEC Foundation undertakes to implement reasonable measures to ensure the security and confidentiality of data but cannot guarantee optimal and absolute protection of transmitted data.
Article 9 – Links to Third-Party Sites
The Site may contain links to other websites. The HEC Foundation has no control over the content of such sites and cannot be held liable for their availability or content.
It is also not responsible for their privacy practices. Users are encouraged to consult the privacy policies of such third-party sites before providing personal information.
Article 10 – Modification of the GTU
The HEC Foundation reserves the right to modify the GTU at any time. Users are encouraged to consult them regularly. Modifications take effect upon publication on the Site.
Article 11 – Governing Law
These GTU are governed by French law. In the event of a dispute and after attempts at amicable resolution, the courts of Paris shall have jurisdiction.
